Terms of Service
Last updated: April 2026. These terms govern access to and use of Moko Speak (the “Service”) by schools, trusts, and other organisations we agree to serve, and by their authorised users.
1. Agreement
By using the Service—whether as an organisation (for example a school or multi-academy trust) or as an individual user invited under that organisation’s account—you agree to these Terms of Service (“Terms”). If you use the Service on behalf of an organisation, you confirm that you have authority to accept these Terms on its behalf. If you do not agree, you must not use the Service.
2. The Service
Moko Speak is operated by Mokoapp (mokoapp.net). The Service provides tools for practising and improving spoken communication, including recording or upload of practice sessions, automated feedback (for example on pace, clarity, and delivery), and related reports for teaching and learning purposes. Features may change over time; we will give reasonable notice where practicable for material changes that affect you. We are not responsible for third-party services you choose to use alongside the Service.
3. Eligibility and school use
Where the Service is used with pupils or students under the age of 18, the subscribing organisation (typically the school or trust) is responsible for ensuring that use complies with applicable child-protection, education, and data-protection requirements, and for obtaining any consents or exercising any lawful grounds required in your jurisdiction. Moko Speak is intended as a professional tool for supported educational use, not as unsupervised social media.
4. Accounts and security
You must provide accurate information when registering or accepting an invitation and must keep login credentials confidential. You are responsible for activity that occurs under your account. Notify us promptly at hello@mokoapp.net if you suspect unauthorised access. Organisation administrators are responsible for managing user access in line with their internal policies.
5. Customer content
You retain ownership of content you or your users submit (for example video or audio of practice sessions, transcripts, and metadata). You grant Mokoapp a limited licence to host, process, transcribe, analyse, and display that content solely to provide and improve the Service as described in our Privacy Policy. You represent that you have the rights and, where required, consents to submit content about identifiable individuals (including pupils and staff) for processing.
6. Acceptable use
You must not misuse the Service: no unlawful, harmful, or discriminatory content; no attempts to breach security or probe vulnerabilities beyond coordinated disclosure; no scraping, excessive automated access, or use that impairs the Service for others; no infringement of intellectual property or privacy rights. We may suspend or terminate access for serious or repeated violations.
7. Fees and partnership access
Access is typically provided under a partnership or licence agreement with your organisation (including pilots). Fees, billing, and taxes are as set out in your order or agreement. Failure to pay may result in suspension. Unless otherwise agreed or required by law, fees are non-refundable.
8. AI-generated feedback
Scores, summaries, and suggestions are generated to support learning and practice. They are not a substitute for professional advice (including safeguarding, SEND, or clinical advice), formal assessment decisions, or statutory obligations. Your organisation remains responsible for educational and welfare judgments and for how feedback is used in the classroom.
9. Warranties disclaimer
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.
10. Limitation of liability
To the maximum extent permitted by law, Mokoapp and its suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our aggregate liability for claims arising from the Service in any twelve-month period is limited to the fees your organisation paid us for the Service in that period (or fifty euros (€50) if no fees applied in that period), except where liability cannot be limited under applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms, non-payment where applicable, or risk to the Service or others. Clauses that by nature should survive (including liability limits and governing law) survive termination.
12. Governing law
These Terms are governed by the laws applicable in the jurisdiction of Mokoapp’s establishment, without regard to conflict-of-law rules, except where mandatory protections apply in your country.
13. Changes
We may update these Terms. We will post the revised version and update the “Last updated” date. Continued use after changes take effect constitutes acceptance. Material changes may be communicated by email or through the Service.
